As they said on MFGG, it's probably not entirely legal to profit on a fan game If you stick by those rules, it's not legal for the MFGG or The Spriters Resource to exist since these websites both have advertising and make profit on material owned by others.
...no they don't?
I think they do but anyways this discussion is useless without any attorney or lawyer which actually has knowledge of these things so I think it's a good idea to just don't mind that and stick to my request.

Hey! I've played you're game before! Great stuff man.
Kinda disappointed there weren't any power-ups or anything, but I liked it.
If you're open to it I have a few Mario platforming ideas;
*cough*
Oh my, my cough is so bad I'm spitting things up!
The idea was to have so many powers ups say to solve puzzles or simply complete levels with many possibilities.
(Edit: Wow, that stuff is incredibly old.)
If you don't care TOTALLY COOL. you are still the man.
Although if you need a new cool Mario sprite I'm your main guy. Somebody tell him about the 100 Mario thing (that I never finished.)

Woah ninspriterx, those ideas are great! And ofcourse the sprites too, did you them? If so, are you interested in doing the spriting for part 3 of my game?

I still dislike the idea of you paying a spriter for this, as it isn't legal at all.
And mfgg and tsr can exist because they do not make profit from the sprites/games. They contain fangames, which, when done completely for free, and because no one is claiming rights to a copywrited character (ie mario) they are entirely legal. Whereas you cannot pay someone to remake a copywrited character.
But whatever. As you said, I doubt anyone'll find out. So long as you don't charge anyone for the game or anything.

Why thank you. Yes, along with the idea I made the sprites too.
Here's a little evidence to show I am your man for Mario.
Ha I may be interested, if it's fun. I have a project going on right now, but I'm sure I could fit this in. Just let me know of all the things you have in mind.
And yeah, don't pay me. Legal stuff and all that. Just have my names in big letters is all. (But I wouldn't mind getting a little cash tip ho ho ho ho)
Makin' a Mario fan game doesn't get too far, especially money-wise. Experience? Hell yeah, and hey, you ended up on Kotaku too!
It all just seems very interesting.

actually yes it is
there are legal loopholes there
he can pay them for the work they put in and access to use art that the spriters made
but
he can't pay for "mario"
get it?
he can pay them to make things for him, but he can't pay for the mario character itself, if that makes sense to you
also no, tSR makes no profit off of hosting sprites

Well, the spriter could just do some sprites like normal only I'd be giving a donation (that's the key word here!) for his work. The sprites remain his/her property, that's for sure, so I'm not buying anything.

I took a break and never got back to it, I'm sorry. I do mean to get back to it though.
So, Kenny. Spriting Mario, I'd be glad to be apart.
