Umm... Nintendo would be lazy if they dropped 3D altogether in their games for the DS. They haven't though as they're using it selectively, though the memory limitations of the DS may be playing a role as to why 3D isn't used frequently in Nintendo published games.

Fuck your limitations. Look at the N64, and how many 3D games were on it. Do you know how much memory was on the largest N64 cart?
32 megs. 32 fucking megs. Hell, the first Turok title used 8 megs! With DS cards likely being upward of several gigs (I assume so, considering how dirt-cheap flash memory is nowadays), memory should not be an issue.

I would, but not with the terrible controls you posed.
The controls should go like this:
B- Sword
A- Action
L- One of the bottom C Buttons
R- Shield
X- Z Target
Y- One of the bottom C-Buttons
Select- Up- C
Top Screen: Gameplay
Bottom Screen: Map (ONLY. NO TOUCH CONTROLS.)

The only thing the touch screen would do would is show the menu, you wouldnt want that?
Also what if it gave us options to set our own controls, would anyone buy it? I think its worth it.

How the hell was SM64 ruined on the DS? I fucking loved SM64DS. Only thing that was bad was how utterly useless Wario was.
Also, why hasn't there been a decent Wario game on the DS? You'd think Wario would be plastered all over the DS like he was on Gameboy. Guess not eh?

No. I don't want any touch controls at all. Pressing start and using the D-Pad works just fine.

Many of the 3D N64 games utilized 2D elements due to the memory limitations. If you tried to make a full 3D game without using 2D elements in places, you will max out the memory in a hurry leading you to having to either compress the data in some fashion (like what Square-Enix used for Chrono Trigger on the SNES), omit adding content to the game, or cut content altogether from the game.
The most a N64 cartridge could hold is 64 MB, but most third-parties were frustrated by this limit and turned to the Playstation as it's discs could hold way more data than a cartridge could ever hold.
DS game cards do offer more storage, but at the cost of data transfer speeds. The more data in a DS game card, the slower the DS gets reading data off the card. So 2D elements are still used in 3D games for the DS these days.

No. I don't want any touch controls at all. Pressing start and using the D-Pad works just fine.
viper, hate to say it but your controls aren't really great as nickslayerwhateverhisnameis controls, but it's probably a lesser between the two.
To be honest, I'd rather have some touch screen control then have none at all, fuck, if you had at least some creativity then you could actually pull it off right.
far as I see it just keep the menu on the pause screen, I really hated the fact that every single thing could be done on the Touch screen without even pausing, it kind of made the gameplay broken on PH.
hell, you can at least have two of the three items out on the button layout, and select what two items you can have on the touch screen. That and you can keep navi only on the touch screen. item buttons can be Y and X
still, i'm not changing my opinion about OoT being on DS.
