Are Xbox Live Avatar Items apporpriate to upload?

I've began ripping some items (mostly props) from the Xbox Live Avatar marketplace. Are they suitable to be uploaded? I'm afraid they might either not count as a game or count as piracy. If they are safe to upload, where should they go?

As for the game, I'd say call it "System BIOS" to match the rest since, if I'm not mistaken (though I probably am), they can also show up in other Avatar-supported games?

Oh hey. Just curious, could you rip the Red Baron items from Snoopy: Flying Ace's avatar items, and the Hatty Hattington items from Battleblock Theater's avatar items?
