I don't know a lot about copyright laws, but I believe that it is legal-action worthy if he's using copyrighted material for profit. You can even read on the op:
"MonsterMMORPG was once called as PokemonCraft. It was a Pokemon MMORPG being developed by me. It started as my graduation project . I am a computer engineer. I started developing at 2009 and since then i am developing. Game was up almost with 99.99% until Nintendo forced to shut down our game. But i did not give up on my game and removed all of the nintendo copyrighted stuff from my game. Now it is a unique Monster MMORPG game."

This means, he is no longer using copyrighted material that could put him in problems.

Did you not see the link I posted? How about 400+ pokemon right there? Not saying it as a dick; saying it as there is copyright content in his game engine(you're telling me all the actual Pokemon algorithms do not fall under copyright law?), he has Zelda and Pokemon sprites/tiles in this game, and has an entire page of pokemon on his website.

I think there is plenty cause for contacting Nintendo.

Oh and Digimon has completely different algorithms for damage and abilities.
