yea i know that Nick is a waaaaay better spriter than me, but thats not what i meant

I meant I make a completely different assist using Torch
and theres also the Torch in Nick's Assist

It's understandable that you'd like to sprite something yourself to be used in the game, but there's just no point in taking up another assist slot for the same character.
Alternatively, even if you did make another sprite of Torch, you'd have to match the proportions, style, everything of Nick's or it would be really inconsistent.

EDIT: Spriting a complete assist out of Torch before claiming an assist spot is a good route, as it ultimately won't get in unless the sprites are done anyway. You might also consider whether another character or assist might use Torch in one of their attacks.
