That Halo game was a hoax, I believe it turned out to be Bond hack.
Rare was second-party yes - but Nintendo never owned them. They had a large stake in the company (something like 49%) and no doubt funded a lot of the stuff they did. But they were never owned by Nintendo.
And that's the important thing to remember. Banjo, TipTop, Conker - Nintendo never had any long-term rights to them. If Rare had tried to make a Conker game on something else they would probably be legally entitled to BUT then Nintendo would have pulled the funding and it would have made their relationship bad and hurt Rare a lot financially (and the funding given for the Conker's BFD more than likely had a: By accepting our money no one gets Conker for 4 years or something clause).
Basically Rare owns everything but Diddy when it comes to DK:R as there is no reason why this would not be the case.
If Sonic & Sega All-Stars became Mario with Sonic & The Sage All-Stars the only thing Nintendo would own would be Mario.
Anyway - my point isn't that your wrong or right - but just that you had no real facts. I liked your writing style, it was a fun read so I'm not trying to dump on you here and yes, I know it's only a fun little blog but it started off asking all these questions and then just kind of ended with "I don't know" - it's like if on Matrix he'd taken the other pill.
