I'm siding with Sportoise. The issue was usage of sprites with denied permission. In any and all cases, despite any pros from allowing permission, usage is denied. This is different than simply *not having permission from an author without his consent because he publicly made it known.
*Meaning that the author neither allowed or denied permission due to being unaware.
None of the reason you gave Midi are objectively valid. What SSF does holds no weight here. Neither does Nintendo's failure in attempt if everyone continues to use their stuff anyways. Someone else robbing a bank and succeeding doesn't justify you doing so too.
