Nintendo is a business. Their objective is profit. Doing this gets them a lot of profit, really quickly.
What people choose to do with the items they legally purchase whether they choose to play it, sell it, or hoard it for years untouched in a box is none of Nintendo's business whatsoever. They already got their money for each and every one of those 3DSes that was bought, and the result would have been no different whether scalpers bought them to resell or a different individual person bought each unit. The amount of money Nintendo sees is the same regardless.
A customer is a customer.
You can argue about how moral it is for the scalpers to do what they do all day long but Nintendo has nothing to do with what happens with their products after the product leaves the store.
If they were truly that concerned about "devoted fans" not getting the 3DS because there aren't enough of them out there, they'd release more.
