For use in a free game, usually it should be fine. Even straight-up commercial sprites are used in some, and most of the time there's no issue. If there is it's usually just the owner asking for it to be taken down or changed, which then happens.
In a commercial game there may be some more details. Obviously plain recolours aren't acceptable, but you should also make sure that you're not remaking the sprite with just a couple of added or removed features.
If you just use it as a reference in terms of techniques, poses, etc but make your own character, then it should generally be OK. That's part of the goal of TSR; as reference and inspiration for other spriters.
