Even if none of the DLC characters are presently spirits, that isn't really proof that spirits remove potential characters. Truth is, we won't know until Sakurai makes a statement.
I wouldn't think a Spirit would deconfirm anything, though. That would be awfully limiting to both the roster and the spirit system. Imagine having to not include a really popular character as a spirit "Just in case."
