Are super mario sprites legal to use?

Is the development console obligatorily needed?
Can´t they just edit a console you already own?
Or better yet, don´t do it and just test it with homebrew and other hacks?

I'm new to this forum so I don't know if I'm on the right place to ask my question, sorry if I am wrong.
I'm plannig to create a game that I will possibly post on an app store (google play store), and I was wondering if it is legal to use some of mario sprites to create it. the game will be totally different from the super mario game, these are the sprites that I'm planning to use:



Q2) Are all the sprites that are on this website legal for commercial use?

Nope, it's impossible to use any of these ripped sprites/models in commercial projects. You may get a Cease and Desist from the copyright holder and even legal pursuit.
