Diddy Kong Racing DS doesn't mention the characters being owned by Rare. You'd think they would have mentioned that just like how they mentioed Geno was owned by Square in M&L S.
Timber's hat logo was changed from Rare to Nintendo.
The ownership of those characters is really nebulous.

So I can imagine there will be a bunch of bitching about the return of the dragoon, but I like that it's back. My friends and I would wollop each other for the chance to use it and it was always a load of fun tricking whoever got it into using it at the wrong time.

Ah let me explain the legality of it all. This was discussed like crazy on another forums I go to and we got an answer.
It turns out characters like Timber are owned entirely by Rare and only Rare, while characters like Banjo and Conker are owned by Rare and Microsoft.
