Hello !
The game is SM3DR in development, they will have many high quality 3D models from many games as Sonic, The Legend Of Zelda and many others...
Developed in Unity Engine 5 with newgen lighting(GI) and high graphic water and original sounds !

That's neat, but the only downside of this is that something like this is bound to happen. I know, it's silly - but it kinda had the same intentions as you currently do. "I'm just making this as a demo" -- and it didn't really fly. Not even with Nintendo's legal team.
I'd try to make a fun platformer, or an enjoyable kart-racing engine with an antigrav mechanic - but I'd just be reaallllyy careful about using assets from Nintendo properties is all ;P especially given that 3D World and Mario Kart 8 are still sellin' like hotcakes on the Wii U.
Now, I'm not saying "DON'T DO IT": by all means I'm saying "DO IT, but BE CAREFUL USING MARIO on ideas this cool"

I still don't get why fan works are such an issue. Legal teams shoud encourage it, in fact. It will teach people to use the assets they know and love to develop interest and talent in gaming careers. It's not like people make money off fan-games. Copyright laws are so full of bullsh!t that nobody can is able to express any kind of creativity!
If anything, making and releasing a fan-game, fan sequel etc. raises awareness of the real thing and makes people buy it.
I, for one, am making a Super Smash Bros. fan-game, which uses various assets from Smash Wii U, others AND original ones. With new features not present in official games. It's a fan-made sequel. A fully 3D one, also made with Unity 5. Unlike Crusade and the like. It will be completely free of charge. My purpose is to try and challenge myself to make a large-scale game. I am working on its website on Wix, and I put up disclaimers on it: that it's not from Nintendo and to encourage players to buy the real deal and support Nintendo and the companies that made my roster's characters. I started development on it after the real thing had such crappy rosters starting from Brawl. In my view, nobody makes these things to screw Nintendo out of profit.
However, when it comes to remakes and ports, like the OP's projects, I understand a lot more. It's a complete copy of the idea. I don't blame Ninty.

Maybe I just don't get it, because it's a stance that, in my view, discourages creativity and fan art using their material as a base. By their logic, fanfiction writers who use Nintendo characters should get C&D's too.
I wonder what keeps projects like Smash Crusade alive.

Sincerely I have do this game for training me Unity use and currently on the android developpement.
I have no connaisance on 3D modelisation and animations, that's why I use the Nintendo models for my games because he suits to the style of the game.
But I do not intend to monetize the game and at the moment I doubt to distribute it .
And even if I try to sell it (what is very very very very (infinite) little likely), a copy of the original game will be bought for Nintendo , but the game(set,play) will have no sale because is better to buy directly the original game.
@Kosheh Thanks for checking , that suprised me that Nintendo is worried in 2015 for a game out in 1996 whose haven't sales !

Fanfics are also prone to legal actions. No one does it tho because it's not worth the trouble.
Any utilization of an IP without payment of royalties is legally prohibited, but devs will only threaten projects that can be really detrimental for their sales.
Fanarts and Fanfics aren't a threat for game sales, but we're talking about a remake of an existing game. Of course it will be a problem.

Actually, Nintendo's got an incredibly strict policy on this and stress that their copyrights stand on their videogames for 75 years after their release.
I think what I was trying to state is like...you're making a game that's resembling a 1:1 copy of the original. And then releasing it for free. So like...
people who don't have a Wii U can enjoy Super Mario 3D World...without a Wii U. Without paying for it.
And that's not concerning you in the least...?
Honestly, if you said "I'm making this game for Windows with Mario and his friends, but it has ALL NEW LEVELS!" Nintendo probably wouldn't have a problem with it at all. Then it's a fangame. But saying "I'm going to remake this game that came out two years ago and I'll make it FREE for everyone to play!" is something that...might...maybe...cause a little concern once you announce plans to distribute it to people on the internet.

^THAT I agree with 110%. A fan-game is much more likely to slip through the legal team's net than a complete 1:1 copy. I'd be curious to see "new" levels on this. ^^ I have no recollection of Nintendo being bothered by fan-games, because it's a small user base that doesn't threaten their sales.

Well, you don't have to cancel everything about this project.
You can easily turn it into your own 3D Mario fangame and making it unique by redoing the level design and adding new features that you can come up with (or taking some from others Mario games than 3D World), that would make your project more interesting as well than just a 1:1 copie of 3D World

Exactly. Nobody said to outright cancel the project. Calm your horses.
3D Mario fangames are rare, if they even exist. You'd have an edge there.

I'm currently customising MKW races with MK8 objects and many optimisations.
I "pause" this project until ideas comes to me...

I do have many ideas, indeed, but then it depends what kind of game you personally want.
A whole new Mario game, perhaps with some custom made Power Ups, would be particularly interesting, I think.
