It looks like he's using the standard kart, like he did in Mario Kart DS, so so far it looks like he is still just the Download Play character. Hopefully he ends up being unlockable or something, though.

He is, there should be screenshot somewhere where he is thrown in the air by a Mii racer.

he's in the first screenshot koopaul posted, the one with the mii using the super leaf.

he's driving a vehicle that isn't the standard grey kart, pretty sure he's a regular playable character.

I image if people are download playing without a cartridge it will probably use their default Mii from their 3DS. So Shy Guy is probably a genuine character.
